Regulatory compliance for CDL drivers (FMCSA / DOT)

Summary of U.S. federal drug & alcohol testing requirements for Commercial Driver’s License (CDL) holders operating commercial motor vehicles (CMVs) under 49 CFR Part 382 and 49 CFR Part 40. Employers and drivers must also comply with the FMCSA Drug & Alcohol Clearinghouse.

Who must be tested

  • All CDL-required CMV drivers operating vehicles that: weigh ≥ 26,001 lbs (GVWR/GCWR), carry ≥ 16 passengers incl. driver, or transport placarded hazardous materials.

Required test types

  • Pre-employment: Negative result before safety-sensitive CMV duties.
  • Random: Unannounced; employers must meet current annual random testing rates.
  • Post-accident: After qualifying crashes; collect specimen as soon as possible per Part 40 timeframes.
  • Reasonable suspicion: Based on specific, contemporaneous observations by a trained supervisor.
  • Return-to-duty: Negative result after violation to resume duties.
  • Follow-up: ≥ 6 unannounced tests in 12 months; up to 5 years per SAP.

Per Part 40 federal panels:

  • Marijuana (THC) metabolites; Cocaine metabolites
  • Codeine/Morphine; Hydrocodone/Hydromorphone; Oxycodone/Oxymorphone
  • 6-Acetylmorphine (heroin); Phencyclidine (PCP)
  • Amphetamine/Methamphetamine; MDMA/MDA

Testing procedures

  • Only HHS-certified laboratories may perform federal drug tests.
  • Urine or oral fluid specimens; strict Part 40 collection & chain-of-custody.

Consequences of refusing/failing

  • Immediate removal from safety-sensitive duties.
  • SAP evaluation and completion of return-to-duty process.
  • Mandatory follow-up testing per SAP plan.

Employer responsibilities

  • Maintain a compliant testing program, records, and supervisor training.
  • Register, query, and report in the FMCSA Clearinghouse as required.
